It is not legal to shoot a dog in Texas unless the dog is running livestock.

However, if the dog is out running deer or disrupting a deer hunt... some hunters take deer hunting seriously and will shoot a dog. That is why I am very careful where I hog hunt with my dogs during deer season.

A friend of mine got one of his dogs killed during deer season and we went to court and we lost because the man said that he shot the dog because he was running cows. This dog was completely cow broke and we even went in with a video to show the judge that the dogs were cow broke but it was his word against ours....

Terry it is not to late to file charges against the man. Even though it is a criminal offense you can file a small claim against him for up to $5000/ He just may be dumb enough to admit it and he will be liable both ways Cival and Criminal but I would definately call the sheriff an make a claim. If you have any witnesses you may be in business

X2 Don't say anything to the sherriff about it being illegal to shoot a dog. You never know if they are in the same good ol boy network. Just simply state that the man shot your dog. You might get lucky and the man may be cocky enough to admit it. If he does admit he shot the dog just because it crossed the fence, the leo will document it and then you may have something to work with. JMO

terry my name is monty and i hunt the mallard and 5f and i heared that this guy did this cause the game warnden checked us that same night and i told him that a land owner slash deer hunter cant just shoot a dog if it is on their land. he said if it threatens him or live stock or destrors land then owner or hunter can shoot dog.i told him that deer are not live stock, the shooter told him that he taught the dog was going to bite him so thats why he shot yur dog. and then hunter said you pulled a knife and put it to his chest if so than we should be one less deer hunter. but he was in the wrong for shooting sam and you should have waited til dark. thats why i hunt at dark rite now, the wkend befor that happened i walked right by that same deerstand and theres no way sam could have gotten to that hunter cause its off the ground and metal. me and justin went are going by his travel trailer and letting him no we hog hunt all around him and see what kind of response we get out of him. i hope its good cause he has alot of goats and i would hate to pull that traveltrailer down the road . if he gets away with this im afraid he will do it agian until we stop him. call me we can go hunt 940 210 0055

Oh hell no! You shoot my dog and it is on like Donkey Kong! Put a knife to his chest? I doubt that without even knowing you. I wish you the best and hope this man learns to never shoot a dog again. I have had lots of dogs run through when I was hunting deer but never shot one. I did think about it but I learned that it really does not effect the deer.

i hate to say it but i can see it both ways i live on a ranch and we have alot of dogs dumped on us and we do shoot a lot of them  but you have to remeber that there are alot of people that call there selfs hoghunters and dog men and dont have a clue and there dogs kill and tear up cattle so it still isnt right that the hunter shot you dog and i would call the cops but just my two cents

First of all...it was WRONG for this guy to shoot your dog. But even if he is prosecuted it wont bring your dog back. This is a very sad deal. This is why we are very careful not to let our dogs encounter deer hunters during deer season. Dogs dont know anything about bounderies or how much money people spend to go out and kill a deer so we have to protect them. Shooting a dog for treaspassing is illegal but putting someone behind bars wont bring the shot dog back. JMO...

What really happened? Two stories about the same incident on one thread. Would like to hear how it happened by the hunter.

Forget bot sides. I have shot dumped dogs. But never the first time I saw the dog. That man needs a whoop'n and if it was my dog he would have got it right then. I would tell him he can go tell my six and four year old what happened to the dog. He can explain how his deer hunt was more important than their dog. My dogs are part of my family.

Personally I would get some BIG CAT URINE and put around his stand and to hell with his huntig But in Texas the laws are made for the bad and unjust The law states that if it is on your property without your consent then it can be gotten rid of I am going to play the devils advocate and say that the man might of have in the past bad experience with a dog on his property and had bad results I can not say but to just cold blood and shoot it thats not right that dogs lived and breathed just be glad you were not shot or some kid going after the dog he needs to have something brought to his attention pretty fast cause if it had been my dogs he would be buying the dog and my dogs are not cheap I would bring it out to police so that the man had to see that you just do not shoot something and not have to answer to it Good Luck.

We are in South Texas and hunt alot of grain fields that border brush, recently the game warden asked my son and I if our dogs crossed fences or do we run shock collars to keep them on the right side of the fence, I laughed!  He said some property owners don't like dogs on their property, I held back and didn't tell him the farmer I'm hunting for doesn't like the hogs from that guy's property on his farm land!  I know an individual who was prosecuted for killing a feral hog on someone's property, because it isn't classified as wildlife it fell into the hands of the Texas and Southwest Cattle Raiser's jurisdiction as "livestock".  I figure if we ever run into trouble I'll just have the farmer file against the property owner where the hogs are coming from for "crop damage", he should keep his hogs on his property so they don't damage the crops.  It is ridiculous that dogs are treated this way, why would anyone not being attacked even consider shooting one?  Sorry for your loss.
Don't let it rest, folks need to know you can't just go around killing dogs.

So you think it is ok and funny to cross fences?
Not knowing all the details- The property owned messed up and shot a dog. The dog owner messed up by hunting close to a fence during deer season.

I herd of some boys gettin some dogs shot last year hunting during deer season. Not only did they shoot them but they cut the straps off there vest and cut collar and smashed there tracking collars. When it was all said and done the men paid for the dogs, vest, and collars. Now the men that shot the dogs did not own the property. not sure about your situation.

Seems like every year i hear about stories like this. Its a sham and that guy was dead wrong for killing your dog but...................hunting dogs at day time during deer season is like playing with fire! You do it enough and you are going to get burned.

Last weekend I had a couple of my dogs out and they went further out than I expected and ended up under a man and his wife in their deer stand.  After following the garmin through some back roads I found them at his house and he wasn't real happy.  He said they were almost shot because he has had a lot of problems with hog doggers cutting fences and trespassing on his property.  After talking with him and telling him I would never do that and that he wouldn't see my dogs on his property again he was more friendly.  I would have been upset if he shot my dogs but I blame hog doggers that cut fences and have no respect for others property as much as I do land owners that shoot dogs.  I'd be willing to bet there would be less dogs shot if land owners didn't have to deal with the people that give hog doggers a bad name.  Just my .02.

Sorry to hear about your dog.  I am not one to usually get even or be resentful but, I would make the rest of his huntin season....shall I say, very challenging!  I own a local beauty shop and would be willing to save all the extra hair from hair cuts that I do!  lol Put the hair in a pillow case with holes and just start shakin!! It will leave a human scent and there will not be a deer around....especially not a wise nice buck!! Trust me, I m a woman and it does work! lol Just my 2 cents.  Good luck and if you need a pup, Ive done it before and will do it again...gave to a fellow hunter!  I had a litter born on 11/28/10, all yellow black mouths, out of our good dogs. Come pick one out!  Good luck and sorry for your past luck.

It is clear in wise county texas hog hunters dont have much to stand own as far as help from the law. game warden and sherif came to my home to talk and investigate. informed me that I cant tresspass own some one else to comfront them about my dog. he ask me if I threatend this man. I told them just as the man is a coward and dog murder he is also a lier I never pulled my knife own this man. I simply grab him by his right hand like a hand shake and did not let him go in till I told him he did not have to do this act I did not cuss him I did not theaten his life are bodly harm. I just imformed him that this is a small comunity and I have lived here for ever and never experianced such. I was point blank in his face.I told him we will run into each outher again some where in town and it will be diffrent. for he will not be able to hide behind the law that he can kill anything that tresspases own his property.Gentel men I am great full for your responce and encouragement. But it is over now It cost me dearly I have learnd a hard lesson and morned over this long enough. I will find myself a new strike dog and get back to hunting. The lord says to ( save room for his wrath when it comes to revenge) im going to give him all the room he needs. Terry
