There was more to this story. The landowner was fearful for his livestock, and had livestock showing injuries consistent with dog attack. Also, out of 15 dogs on the ground, he shot 5 of them, all very close to his vehicle. This substantiates him being fearful for his own safety as well. The dogs (unfortunately) were blue ticks and pit bulls.
I am very active in talking owners of shot dogs into pursuing legal actions when dogs are unlawfully shot. I do what I can to dig up case law for their attorneys (got a job offer from an attorney in Houston for this), as well as offer my assistance in any way needed. I am currently working with Mr Boyd of Whitesboro, TX who had his TX State Champion shot and killed off a Coon, and would have loved to jump head first into this Oklahoma case. However, with the information that I currently have, I believe that this landowner truly was afraid for his own safety and that of his livestock, making the killing "justified". It's a bad deal either way, but to be completely fair each case must be scrutinized from both sides. Would I be mad if my dogs got shot? You bet I would. I have a bad case of the red tail for unlawful dog shooting as well as BSL. I am more than willing to jump in the ring to fight for each of these issues, and I am highly suspect anytime a landowner takes the "I was fearful of my life or that of my livestock" defense. In this case, however, I do truly believe that the landowner was within his rights.
