Thats a shame Levi. Thats why I have trouble hunting a new place where I know nothing about the bordering properties, because those types of people can pop up anywhere.  Glad you were able to keep your cool and not do anything foolish.  If the dogs come up shot, then its to time to take it to the next level.  Evil

Shooting a dog just because it is on your land is a criminal offense. He said that he told his guys to shoot any dogs they say which would be a crime. The discussion that plans out a criminal act is called conspiracy. That is a separate criminal offense in itself and charges can be brought even if they never actually commit the criminal offense that was discussed. So the man and who he talked to may have already committed conspiracy. Allegedly. I think you should report that to law enforcement. Grin I expect my dogs to do their job and they expect me to take care of them with the same level of commitment they show me. The best way to win a fight is to let someone else do the fighting.

Doesn't that fall under terroristic threat or something? I'd take legal action since you had a witness. Then make some kind of agreement to droP charges that comes out in your favor Wink

I do hope I would have handled it well. But to just come up when I am not doing anything and threaten to shoot my dogs. I might have gone straight to laying of hands.

Im glad you kept your cool because a couple of years ago that same thing happened to me and a buddy, except this guy was shooting at our dogs. We loaded up all the dogs we had and went looking for the rest of them. Then we ran into him and it wasnt good. I told him if he would of shot my dog i would of beat his head in on that dirt road! Then i snatched my dog up and put him on the 4wheeler. I was leaving and he got brave and said that my dogs didnt have no bussiness on his place. I told him thats fine, next time your cows are out i will shot at them!!!

What that ole boy needed was a good ole fashioned Texas ass whippin with a cable lead rope with about 4 snaps on it.They tell me those snaps are painful when they are bouncing off of you head.The guy is a coward and should have been treated as such.

Texas Law last time I read it stated that a land owner can only shoot a dog if it is harrassing livestock, Cows, Horses ect and in the defense of the livestock. If someone just plain ol shoots your dogs for being on the wrong side of the fence I think you got yourself a good ol case of animal cruelty if you can articulate it well enough. As bad as I hate em you could really push the issue with a lawyer and make the guys life a living hell along with takin him to civil court as well and suing his butt off for liability and damages to your property. The guy up front making a outright threat to you would also be good ammo that he wasn't protecting nothing, just plain ol shootin up a man's dogs. If all else fails...good lord please forgive me for sayin this one but ....Tell the Humane Society and let them start banging drums and lighting candles. LOL their always up for a good fight. Just tell them your dogs was lost and was making the great journey home to you and little suzy..

FYI here is some good reading:
The precedence for this was set by Bueckner v. Hamel in 1994, http://www.animallaw.info/cases/caustx886sw2d368.htm. "Texas law allows persons to kill without liability dogs that are attacking domestic animals. However, the attack must be in progress, imminent, or recent. This defense does not apply to the killing of dogs that were chasing deer or non-domestic animals." This case is essentially identical to what is being proposed, except the hog dogs weren't even chasing deer, just running past a feeder.

2 years ago a buddy of mine got his hog dog shot and the man called him and told him he shot the dog. They met up in town and he thru the dog on the Walmart parking lot. My friend got the liscense plate number and tracked him down and took him to court. He asked me to go as a witness and we lost the case. The man lied and said the dogs were chasing cows and we had these dogs 100% cow broke. The dogs were running a hog at the time of the shooting but it was his word against my buddies word. My buddy video taped the dogs walking around the cows and the cows actually chased the dogs and the dogs dodged the cows. tHe judge threw out the case because she said the dogs should of been leashed anyway. The man did admit that maybe the dogs weren't running the cows. I think we could have won if it was trial by jury.

You did right Levi,.....remember this.....NEVER argue with an idiot.....people that don't know you may not be able to tell the difference. Talk to the landowner where you were hunting...may not help a bit, but it just might too. I might also take the idiot a copy of the law about shooting dogs if you can get it.

Never argue with an idiot? I disagree. You just have to communicate in a manner that even an idiot can understand. Take a foot long chain and fold over the end and hold that end. That way it is not long enough for them to take away and use against you Grin It communicates your argument effectively so even an idiot can understand Grin
