I found this on a site about texas laws concerning dogs:
Transporting or confining an animal in a cruel manner is another affirmative act prohibited under Texas law. “Cruel manner” is defined by the statute as “a manner that causes or permits unjustified or unwarranted pain or suffering.” Tex. Penal Code Ann. § 42.09(c)(3) (Vernon 2001). Texas courts have also had the opportunity to interpret what actions constitute “confining in a cruel manner.” In Lopez v. State, 720 S.W.2d 201 (Tex. App.—San Antonio 1986), the defendants were convicted of confining their dog in a cruel manner. The facts indicate that the dog was left inside the car in mid-July in San Antonio. The car had a T-top, and was parked in direct sunlight with only an inch and a half crack in the windows. Although there was no direct evidence indicating that the dog did not have adequate ventilation, the court nevertheless sustained the conviction by relying on circumstantial evidence and testimony from an officer that it was “very hot inside the car.” Id. at 201.
I would think that someone would have to prove that the dogs were in pain or suffering to make to ticket stick. The only problem with this law is the wide area of interpretation of "SUFFERING". Good luck, I hope this will help.

I had the same thing happen to me in Clinton Oklahoma. I was coming home from a cattle dog trial in Hereford Texas and stopped by to see my fatherinlaw at the hospital. I parked in the shade away from the other cars , let my tailgate down so the wind could blow through the dog box. I was not there 15 minutes when they called on the overhead speakers for the owner of the red supercrew 4x4 to come to the front desk. When I got there a woman police officer was waiting on me. She started telling me that someone called in that the dogs were hot and had no water. I told her to walk out to my truck with me and take a look all the dogs were sleeping. She said it was not a good deal to haul dogs in the heat and I very nicly told her that I thought more of my dogs then most people thought of their kids. I take every precaution when I haul or hunt my dogs in the heat. The long and short of all this is if you think Oklahoma and Texas is bad don't haul dogs to Califonia they get really excited!

Ask them if this is acceptable. You can see that they're so cramped in that back seat that they have to sit on top of one another.
