Have yall read/heard anything on the new dog chaining/tethering law???

Been looking like mad to find and inform myself on it and cannot find it to save my life---I did read it on the scrolling notes at the bottom on Fox35 news, but I cannot find any article.

At least there is some discussion and debates.  Our county passed it without too many people knowing until it was already done. I'm sure it was advertised but not one person that I know heard about it until after the fact.

theyve been talkin about it for about a year now.  I dont see the pen thing passing, and last i heard tethering hasnt changed here yet.

Just a side note:  To see my pens or if i had a dog chained in my yard you would either A: have to walk onto my property and look over my 6' privacy fence or B: go into my neighbors' yards and look over my 6' privacy fence.  Now to charge me with a crime you would need a search warrant to do either.. Just sayin  Wink

Ok here is the short version..  To investigate a crime without a warrant you can enter upon property that is not gated or fenced to make contact.  To search the premises you need a warrant, with the exception of exigenet (spelling) circumstances, or to conduct an officer safety sweep (which really wouldnt be relevant in this case.  Now if you can see the crime from the roadway or place you can legally be, you dont need the warrant to seize evidence (plain sight doctrine).

If your yard is fenced and animal control (aspca) what ever they are called in your county comes knocking on your door tell them pound sand and time to leave.  Unless they have a legal reason to be there than cant refuse to leave.. Just remember youll never win an arguement on the street, be polite tell them they dont have your consent and that youd like them to leave.  Theres alot more to it, but if you want to kow ask them why they have the right to be there, and then do some research on the topic.  there is a bunch of case law out there, and most of its availible on the net.

The way LEO's minds work is amazing lol almost like a lawyer....our animal control thinks they can blow smoke and get their way since they hate dog hunters (especially me) thankfully I have two cantankerous ritirees living next door to help me out.

The way I took the article that it was County enforced not State wide, am I missing something?  I wish I had time to keep up with all of the Fl. Bills they are trying to pass.

Yeah thats about the way it has to be.  the major differences between the two are A: Pay, B: time to decide on how to do what needs to be done..  My dad and i debate things all the time, hes the higher paid of the two.  Embarrassed

My understanding is this is a county to county thing.  Here is a link to the Florida State Statue regarding animals.  Just remember there is case law for everything, and rarely do they update Statues to reflect it..

Oh and counties can make Ordinances which make those laws stricter.  If you wanna know your counties get a copy from the Clerk of Court.  It is public information you just gotta ask.. Hope this helps yall.. See cops can be nice once in a while  Grin

It passed. As the same law has been passed in Orange and Seminole county.

This organization http://www.dogsdeservebetter.com/ is fighting to have the law passed in the majority of Fl counties. Starting in the major populated areas, Then it will be very simply put into state law as it will already be passed in most counties.

That is the so called home county of the so called "Central Florida Dog Hunters Association" and not a peep from them. Not even blip on there outdated webpage.

The wall is coming down one stone at a time!





An ordinance passed Tuesday, April 10, 2012, in Lake County bans pet owners from tying their animals to a single object with a chain, rope or leash.

TAVARES --

Lake County commissioners have unanimously passed an ordinance that prohibits tethering or chaining dogs, except when their owners are outside with them in the yard.

County officials said they plan to educate the public about the new rules first, before starting to issue fines in November.

Those who violate the anti-tethering ordinance could face a $150 fine after a warning, and could be fined $500 for each additional violation within the next five years.

Dog owners could also be hit with a $500 fine if the dog is injured, and a $1,000 fine if the dog dies while tethered.
